Welcome! This Privacy Policy explains how Buildertrend Solutions, Inc. and its affiliates (“Buildertrend”, “Company”, “we”, “us” or “our”) collects, uses, discloses, and otherwise processes personal information in connection with our websites (the “Sites”) and other websites we own and operate that link to this Privacy Policy, and the related content, platform, services, products, and other functionality offered on or through our services (collectively, the “Services”). This Privacy Policy applies to our processing of personal information about the following types of individuals:

  • General Contractors: Our homebuilder, remodeler, and specialty contractor customers and prospects that use the Services.
  • Subcontractors: The construction and specialty subcontractors of our General Contractor customers whose information is processed through the Services.
  • Homeowners: The clients of our General Contractor customers that may engage with our Services and other individuals who we have a direct relationship with to assist with their home renovation projects.
  • Non-Users: Website visitors, prospects, and the individuals who communicate with us, either online or offline.

This Privacy Policy does not apply to our processing of personal information relating to job applicants, employees, and other personnel. Additional or supplemental privacy notices may be made available to you in connection with, and applicable to, certain Services, such as our financing Services.

Where we have a direct relationship with you, and we are not acting on behalf of another customer, Buildertrend is the controller of the personal information we hold about you in connection with your use of the Services. This means that we determine and are responsible for how your personal information is used. In other capacities, where we are processing your personal information on behalf of another Buildertrend customer, Buildertrend is a processor of your personal information. In such cases, the Buildertrend customer is the controller of your personal information, and we are acting as a processor on their behalf.

I. Our Collection and use of personal information

When we use the term “personal information” in this Privacy Policy, we mean any data or information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular natural person or household or any other data or information that constitutes “personal data”, “personal information,” or “personally identifiable information.” Note the below categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties for their own marketing purposes.

1. Personal Information Collected from You

We require certain personal information to provide the Services to you. If you do not provide the personal information that we ask for, it may delay or prevent us from providing the Services to you.

The personal information that we may collect directly from you includes the following categories:

  • Contact Information, including first and last name, business email address, business postal address, employer, job title, your area of responsibility, company name, phone number, your country or region and communication preferences. We use this information to fulfill your request or transaction, to communicate with you directly, and to send you marketing communications in accordance with your preferences.
  • Account Information, including first and last name, company name, employer, job title, business email address, user ID and password, profile information, government and tax identifiers, affiliations, and any other information you provide to us. We use this information to administer your account, provide you with the relevant service and information, communicate with you regarding your account and your use of the Service, and for payment processing and customer support purposes. Please note we utilize a third-party provider to process payments on our behalf and do not accept payment directly through our Services.
  • Service Information, including information provided through the use of the platform Services, including if needed, financial account information, payment card information, government and tax identifiers, information about information about current, past, and proposed jobs and other projects, account balances, payment and purchase history information, information about affiliated users, marketing campaigns and any other information you choose to provide through the use of the platform Services.
  • Inquiry and Communications Information, including information provided in custom messages sent through the forms, in chat messages, to other users of the Services, to one of our email addresses, or via phone. This also includes contact information provided on our Services. We use this information to investigate and respond to your inquiries, and to communicate with you, to enhance the services we offer to our users and to manage and grow our organization.
  • Newsletter, Marketing Emails, and Blog Information, includingemail address and applicable interests and communication preferences. We use this information to manage our communications with you and send you information about products and services we think may be of interest to you.  If you wish to stop receiving email messages from us, simply click the “unsubscribe link” provided at the bottom of the email communication. Note that you cannot unsubscribe from certain services-related email communications (e.g., account verification, confirmations of transactions, technical or legal notices).
  • Survey Information, including information provided in any responses submitted through surveys, feedback or the content of any testimonials. We use this information to administer and facilitate the Services, to respond to your submission, to communicate with you, to conduct market research, inform our marketing and advertising activities, and improve and grow our business.
  • Event and Webcast Information, including registration information, call-in details, attendee badge information, and contact information. We use this information to administer and facilitate the Services and improve and grow our business.
  • Information Collected Through the Use of the Service, including any files, documents, videos, images, data, or information you choose to upload or transmit through your communications with us or your use of the Site (collectively, “User Content”). User Content and any information contained in the User Content, including personal information you may have included, is stored and collected as part of the Service. We use the User Content to provide you with the Service.
  • Other Information that you provide to us online, by phone or in person, and use this information to respond to your request, provide you the requested services, and to inform our marketing and advertising campaigns.

2. Personal Information Automatically Collected

As is true of many digital properties, we and our third-party partners may automatically collect certain information from or in connection with your device when visiting or interacting with our Services, such as:

  • Log Data, including internet protocol (IP) address, operating system, device type, version and battery status, browser type and version, browser ID, device identifiers and advertising IDs, SIM information, the URL entered and the referring page/campaign, date/time of visit, other user agent string data, the time spent on our Services, and any errors that may occur during the visit to our Services).
  • Analytics data, Including the electronic path you take to our Services, through our Services and when exiting our Services, UTM source, as well as your usage and activity on our Services, such as the time zone, activity information (first and last active date and time), usage history (flows created, campaigns scheduled, emails opened, total log-ins) as well as the pages, links, objects, products and benefits you view, click or otherwise interact with. We may also analyze the interaction between General Contractors, Subcontractors and Homeowners using our Services.
  • For example, we use Google Analytics to recognize you and link the devices you use when you visit our Services on your browser or mobile device, log in to your account on our Services, or otherwise engage with us.  We share a unique identifier, like a user ID or hashed email address, with Google to facilitate the service. Google Analytics allows us to better understand how our users interact with our Services and to tailor our advertisements and content to you.  For information on how Google Analytics collects and processes data, as well as how you can control information sent to Google, review Google’s website, “How Google uses data when you use our partners’ sites or apps” located at www.google.com/policies/privacy/partners/.   • Location data (such as precise or coarse geographic location we or our third-party providers may collect, such as via permissions within app operating system or browser functionality).
  • Lead Generation Data: For prospective customers, we may in addition automatically collect information about your use of the Services, including Analytics Data and tie it to information including status in the sales cycle, lead and commercial details (like platform specifics, initial marketing channel), and user and account ID and other identifiers (such as internal CRM IDs), user profile/history data, account health status, event attendance, status as lead/account, integrations.

3. Personal Information from Third Parties

We obtain personal information from sources other than the individual, which we often combine with personal information we collect either automatically or directly from an individual. In particular, we collect personal information from the following third-party sources:

  • General Contractors and other Buildertrend users who may supply information directly to us, including personal information regarding their own business, employees, Subcontractors, Homeowner clients, and contacts. For example, we will receive information any time a user communicates with you through the Services. We use this information to operate, maintain, and provide to you the features and functionality of the Service.
  • Publicly Accessible Sources, such as property or permit records, corporate websites, trade and business licenses, professional certifications, permits, trade association membership, and e-commerce marketplace profiles (from these sources, we may obtain business information on both business people and companies). We use this information to operate, maintain, and provide to you the features and functionality of the Service, as well as to communicate directly with you, and to send you information about products and services that may be of interest to you.
  • Social Media, including when an individual interacts with our Services through various social media networks, such as when someone “Likes” us on Facebook or follows us or shares our content on LinkedIn or other social networks, we may receive some information about individuals that they permit the social network to share with third parties. Individuals should always review and, if necessary, adjust their privacy settings on third-party websites and social media networks and services before sharing information and/or linking or connecting them to other services. We use this information to operate, maintain, and provide to you the features and functionality of the Service, as well as to communicate directly with you, such as to send you information about products and services that may be of interest to you.
  • Service Providers, including our service providers that provide technologies and perform services solely on our behalf, such as web hosting, CRM, survey and marketing providers and payment processors. The information may include contact information, demographic information, payment information, information about your communications and related activities, and information about your use of our Site and Services. We may use this information to administer and facilitate our Services, your orders, and our marketing activities;
  • Business Partners, including companies that offer their products and services in connection with our Services, such as home marketing sources or customer due diligence providers. We may use this information to administer and facilitate our Services, your orders, and our marketing activities.
  • Authentication Services, where some parts of our Service allow you to login through a third-party authentication service such as Intuit. These services will authenticate your identity and provide you the option to share certain personal information with us, which could include your name, email address, address book and contacts, enable sharing to and from the third-party platform. The data we receive is dependent on that third-party’s policies and your privacy settings on that third-party site. We use this information to verify your identity, and operate, maintain, and provide to you the features and functionality of the Service. 
  • Other Sources, including third-party data providers, market research surveys and/or interviews conducted by our partners or industry groups, brand partnerships, or through transactions such as mergers and acquisitions. We use this information to operate, maintain, and provide to you the features and functionality of the Service, as well as to communicate directly with you, such as to send you email messages about products and services that may be of interest to you.

Through the provision of our Services, we may also process deidentified information that cannot reasonably be used to infer information about, or otherwise be linked to, a particular consumer or household.  Buildertrend commits to maintain and use the information in deidentified form and will not attempt to reidentify the information, except where necessary for satisfying the requirements under applicable law.

4. Additional Uses of Personal Information

In addition to the uses of personal information described above, we may use personal information we collect to:

  • Fulfill or meet the reason the information was provided, such as to fulfill our contractual obligations, to deliver the Services you have requested and to process transactions, including providing you with the white paper you requested or an online product demonstration;
  • Manage our organization and its day-to-day operations;
  • Communicate with individuals, including via email, text message, social media and/or telephone calls;
  • Request individuals to complete surveys about our organization, organizations we partner with, and Services;
  • For marketing and advertising purposes, including to market to you or offer you information and updates on products or services we think that you may be interested in through email, direct mail or phone;
  • Analyze, administer, test, update, improve, monitor, and personalize our Services, including by training machine learning models and recognizing an individual and remembering their information when they return to our Services;
  • Conduct research and analytics on our customer and user base and the use of our Services;
  • Help maintain the safety, security and integrity of our property and Services, technology assets and business;
  • To enforce our Terms and Conditions, to resolve disputes, to carry out our obligations and enforce our rights, and to protect our business interests and the interests and rights of third parties;
  • Prevent, investigate or provide notice of fraud or suspicious, unlawful, or criminal activity;
  • Comply with contractual and legal obligations and requirements;
  • To fulfill any other purpose for which you provide personal information; and
  • For any other lawful purpose, or other purpose that you consent to.

II. Our Disclosure of Personal Information

We may share or make available your personal information with and to certain limited third parties, as follows:

  • Buildertrend Entities and Advisors, includingour affiliates, subsidiaries, legal and financial advisors, and consultants.
  • Your Employer or Company, including where you interact with our Services through your employer or company. In such cases, information about your use of the Services may be available to your employer or other company users.
  • Other Users, including where you use the Services to enable your interactions, scheduling, payments, or any other function of the Services with other users.  We may disclose your contact information, information about the job and other public profile information to users, as well as any other information you choose to provide or make public.
  • Service Providers, who provide services such as IT and system administration and hosting, payment processing, survey, research and analytics, marketing, communications, and customer support providers, and security vendors assisting with, among other things, fraud prevention and fraud detection.
  • Ad Networks and Advertising Partners, wherewe work with third-party ad networks and advertising partners to deliver advertising and personalized content on other websites and services, and across other devices. These parties may collect information directly from a browser or device when an individual visits our Services through cookies or other data collection technologies. This information is used to provide and inform targeted advertising, as well as to provide advertising-related services such as reporting, attribution, analytics and market research.   • Business Partners, including our contracted joint marketing partners and other business partners, who may process your personal information for purposes such as marketing and providing products and services that may be of interest to you and your business.
  • Business Transaction or Reorganization, if we are involved in a merger, reorganization, dissolution, or other fundamental corporate change, or sell a website or business unit, or if all or a portion of our business, assets or stock are acquired by third party, with such third party. Personal information may also be disclosed in the event of insolvency, bankruptcy, or receivership.
  • Legal Obligations and Rights: We may disclose personal information to third parties, such as legal advisors and law enforcement:
    • in connection with the establishment, exercise, or defense of legal claims;
    • to comply with laws or to respond to lawful requests and legal process;
    • to protect our rights and property and the rights and property of others, including to enforce our agreements and policies;
    • to detect, suppress, or prevent fraud;
    • to protect the health and safety of us and others; or
    • as otherwise required by applicable law.
  • With Your Consent to third parties approved by you, including authentication partners you choose to link your account to or publicly, such as if you provide a testimonial.

III. Online Advertising

We may participate in interest-based advertising and use third party advertising companies to serve you targeted advertisements based on your browsing history. We may share, or we may permit third-party online advertising networks, social media companies and other third-party services, to collect information about your use of our online services over time so that they may play or display ads on our Services, on other websites or services you may use, and on other devices you may use. Typically, though not always, the information used for interest-based advertising is collected through tracking technologies, such as cookies, web beacons, embedded scripts, location-identifying technologies, and similar technology, which recognize the device you are using and collect information, including click stream information, browser type, time, and date you visited the Sites, AdID, precise geolocation and other information. We may share a common account identifier (such as a hashed email address or user ID) with our third-party advertising partners to help identify you across devices. We and our third-party partners use this information to make the advertisements you see online more relevant to your interests, as well as to provide advertising-related services such as reporting, attribution, analytics, and market research. We endeavor to adhere to the Digital Advertising Alliance’s principles for online behavioral advertising and to work with advertising partners who do the same.

IV. Control over your information

You may control your information in the following ways:

  • Access to Your Device Information. You may control the Services’ access to your device information through your “Settings” app on your device.  For instance, you can withdraw permission for the Services to access your geolocation and to integrate with your other applications.
  • Email Communications Preferences.  You can stop receiving promotional email communications from us by clicking on the “unsubscribe” link provided in such communications.  You may not opt-out of service-related communications (e.g., account verification, transactional communications, changes/updates to features of the Services, technical and security notices).
  • Cookies. For information about our and our third-party partners’ use of cookies and related technologies to collect information automatically, and any choices you may have in relation to cookies, please see please see our Cookie Notice.
  • Online Advertising: To learn more about interest-based advertising and how you may be able to opt-out of some of this advertising, you may wish to visit the Digital Advertising Alliance’s (DAA) resources and/or the Network Advertising Initiative’s (NAI) online resources, at www.aboutads.info/choices  or http://www.networkadvertising.org/choices/ . You may also be able to limit interest-based advertising through the settings menu on your mobile device by selecting “limit ad tracking” (iOS) or “opt-out of interest-based ads” (Android).  You may also be able to opt-out of some — but not all — interest-based advertising served by mobile ad networks by visiting http://youradchoices.com/appchoices and downloading the mobile AppChoices app.

Please note that when you opt out of receiving interest-based advertisements, this does not mean you will no longer see advertisements from us or on our online services.  It means that the online ads that you do see from DAA or NAI program participants should not be based on your interests.  We are not responsible for the effectiveness of, or compliance with, any third parties’ opt-out options or programs or the accuracy of their statements regarding their programs. In addition, third parties may still use cookies to collect information about your use of our online services, including for analytics and fraud prevention as well as any other purpose permitted under the DAA’s Principles.

V. Children’s personal information

Our Services are not created for nor directed at children. We do not knowingly, collect, share, or sell personal information from children under the age of 18. If you are a parent or guardian and believe we have information about your child or that your child has provided us with personal information without your consent, please email privacy@buildertrend.com.

VI. Links to third-party websites or services

Our Services may include links to third-party websites, plug-ins, and applications. Except where we post, link to, or expressly adopt or refer to this Privacy Policy, this Privacy Policy does not apply to, and we are not responsible for, any personal information practices of third-party websites and online services or the practices of other third parties. VII. Data Retention

We may retain your personal information for a period of time consistent with the original purpose of collection. We determine the appropriate retention period for personal information on the basis of the amount, nature, and sensitivity of your personal information processed, the potential risk of harm from unauthorized use or disclosure of your personal information, and whether we can achieve the purposes of the processing through other means, as well as on the basis of applicable legal requirements (such as applicable statutes of limitations). We will only retain your data for a period of time that is reasonably required for legal or business purposes.

  1. United States
    Depending on your state of residency, you may be able to exercise additional rights granted by applicable law in relation to the personal information about you that we have collected (subject to certain limitations).   2. Nevada
    If you are a resident of the State of Nevada, Chapter 603A of the Nevada Revised Statutes permits a Nevada resident to opt out of future sales of certain covered information that a website operator has collected or will collect about the resident. Although we do not currently sell covered information, please contact us at privacy@buildertrend.com with the subject line “Nevada Opt Out Request” to submit such a request.
  3. European Economic Area, United Kingdom or Switzerland
